Deposit / Payment
I agree to pay the full amount of agreed upon services prior to work beginning on the project. I understand that this amount is considered non-refundable. Due to the nature of the work, if a client has issues with the completed project, then arrangements will be made to fix the problems. This may or may not include further payment for services. Our goal is to maintain happy clients, we keep transparent communication records so that all parties are on the same page with goals for the job.
Client Responsibilities *
Clients are responsible for all costs and charges for setting up their site. These may include but are not limited to: Squarespace monthly or yearly subscriptions, G-suite emails accounts, domain name registration, stock photography, accounting software, etc. The client is also responsible for all of the written content for the site, unless they'd like to pay for copyrighting services through THP. Clients will also be responsible for all photography used in their site, unless they choose to contract THP for business photography services. Upon completion of the client's site, offloading will occur and at that time, THP will no longer be responsible for the upkeep, management, renewal, or any other services regarding the client's website. THP is available for support for an hourly rate of $250 if the client decides to continue working with THP.
Disputes *
INDEMNIFICATION. The client agrees to indemnify and hold Taylor Heery & Taylor Heery Photography harmless from all claims, losses, expenses, fees including attorney fees, costs, and judgments that may be asserted against the client that results from the acts or omissions of Taylor Heery & Taylor Heery Photography. REMEDIES. In addition to any and all other rights a party may have available according to law, if a party defaults by failing to substantially perform and provision, term or condition of this Contract (including without limitation the failure to make a monetary payment when due), the other party may terminate the Contract by providing written notice to the defaulting party. This notice shall describe with sufficient detail the nature of the default. The party receiving such notice shall have 2 weeks from the effective date of such notice to cure the default(s). Unless waived in writing by a party providing notice, the failure to cure the default(s) within such time period shall result in the automatic termination of the Contract.
Final Agreement *
I have the authority to make decisions on behalf of the organization that I am working with / for to hire and work with THP. I have read all of the terms and conditions in this contract and agree to comply with all of them as stated.
